We will not be liable to you or any third party should we exercise such right. 18. Support Requests & Development Time

Support must be requested through our helpdesk so that it can be categorized and responded to in a timely manner. You will be notified via email with information about our helpdesk upon registration and will also find a link to our helpdesk in your WordPress Dashboard. Support requests are subject to approval.

Acceptable support requests would include the following:

* Theme/plugin troubleshooting * Site optimization inquiries (load time, caching, etc) * Plugin/code conflicts * Theme/plugin installation

Unacceptable support requests would include:

* Custom theme/plugin development

* Site design

* SEO setup/troubleshooting

Development hours can be used in many ways. When you make a request, we will tell you how much deveopment time your request will use up, if you agree, we'll deduct it from the total of inclusive hours. Here is a list of requests you can make; Publish new posts or pages. Add, replace or remove an image or video. Tweak design code. Add or Remove products from the e-shop. Design promo Banner. Search engine optimisation. Database optimization. Website visitor report. Scan your website for malware. Setup and monitor online advertising campaign. Technical consultation. Skype Training. Setup and manage mailing list & electronic newsletter. Setup and manage security features: SSL & CDN. Administer your email accounts. Manage your web hosting account. Manage your DNS. Anything else, just ask and we will try to help. We are here to help you succeed.

Development hours can also be used as phone support, chat support. In any-case, all of the above is subtracted from inclusive Development hours. If requested work exceeds inclusive Development Hour(s), additonal Development hours must be purchased and will be billed at our hourly rate of £250/hr. While we will do our best to keep the same developer assigned to individual projects we cannot guarantee this at any time.

18a. In the case where client requests for website to be restored from a recent backup, a charge of £250 is applicable.

19. Termination/Cancellation

You may cancel service at anytime by contacting us and requesting cancellation of services. Your service will cancel/terminate within 7 business days of notifying us.

20. Refunds

We maintain a policy of no refunds. Due to the month-to-month, cancel anytime nature of this agreement we shall not be compelled to issue a refund, pro-rated or otherwise for any reason. We do reserve the right to issue a refund on a case-by-case basis at our sole discretion.

21. Miscellaneous

In any action to enforce these Terms of Use, the prevailing party will be entitled to costs and attorneys fees. Any cause of action brought by you against us or our Affiliates must be instituted with one year after the cause of action arises or be deemed forever waived and barred.

You may not assign your rights and obligations under these Terms of Use to any party, and any purported attempt to do so will be null and void. We may free assign our rights and obligations under these Terms of Use.

You agree not to sell, resell, reproduce, duplicate, copy or use for any commercial purposes any portion of this site, or use of or access to this site.

In addition to any excuse provided by applicable law, we shall be excused from liability for non-delivery or delay in delivery of products and services available through our site arising from any event beyond our reasonable control, whether or not foreseeable by either party, including but not limited to, labor disturbance, war, fire, accident, adverse weather, inability to secure transportation, governmental act or regulation, and other causes or events beyond our reasonable control, whether or not similar to those which are enumerated above.
